Jared Fogle Charged With Soliciting Sex With Minors; Lawyer Says He Has A Medical Problem

Jared Scot Fogle, 37, the former Subway spokesman, will plead guilty to possessing child pornography and traveling to pay for sex with minors.

The allegations involve at least 14 minors between 2010 and 2013. One of the 14 females was contacted by Fogle, who then traveled from Indiana to New York City where he paid to engage in sexual acts with her when she was 17 years old.

According to documents released by federal prosecutors, Fogle has agreed to a guilty plea on the charge of “one count of travel to engage in illicit sexual conduct with a minor and one count of distribution and receipt of child pornography.” Fogle reportedly faces a jail term of between five and twelve and a half years; he has agreed to serve at least five years as part of his plea deal.

The complaint says in text messages with one of the 14 minor victims, Fogle said he would accept a 16-year-old girl while stating that “the younger the girl, the better”. He also asked some of the victims to send him pictures of themselves.  Authorities found photos and videos of boys and girls.

The 14 victims, four are now adults, were identified after police say they reviewed nearly 160,000 text messages, more than 27,000 emails, and tens of thousands of videos and images.

Part of the case involves images Fogle received from Russell Taylor, the head of Jared’s foundation. Russell sent Jared photos and videos from hidden cameras in Russell’s house, featuring children as young as approximately 6.

Under the plea deal, Jared has agreed to serve at least 5 years in prison and must pay restitution of $1.4 millionm, which is $100,000 per victim and register as a sex offender.

Part of Jared’s punishment, he can’t possess obscene materials, he must participate in a sexual disorders program, he can’t have unsupervised meetings with minors, and his computers will be subject to random checks.

Jared turned himself into the FBI today. According to Jared’s lawyer, Jeremy Margolis, Jared suffers from a “medical problem” and is seeking help from a psychiatrist. Mr Margolis says Fogle is already being treated by the psychiatrist, and plans to make amends with his victims.

The Fogle family has released a statement following the hearing:

“Our family is shocked and profoundly disappointed in Jared’s abhorrent criminal behavior and we are very concerned for the well being of those affected by his conduct. At the same time, we are gratified that Jared is accepting responsibility for what he has done by agreeing to plea guilty to the charges filed today and by volunteering to make restitution to the victims. We are also gratified that he is seeking medical treatment. We hope that he will become healthy again and are confident that after he serves his sentence, he will continue to make amends. We look forward to the day that he rejoins our family and society. We will not be granting any media interviews. Our plan is to comfort each other and heal and we ask that the media respect our family’s privacy during this very difficult time.”
