Real Housewives Of New Jersey husband Joe Giudice legal troubles are over, but unfortunately not in his favor.
On Wednesday, Joe’s appeal in his deportation case was denied, per the United States Court of Appeals records.
The final decision comes months after he chose to wait for the decision in the country of his origin. After serving a 41-month prison sentence on 39 counts of wire fraud and bankruptcy fraud charges. He can appeal the decision again, according to Giudice family lawyer, James J. Leonard Jr., Joe is mulling over his options at the moment.
“We have always maintained that Joe Giudice belongs in the United States with his family, not in Italy. The immigration laws in our country are both draconian and antiquated and need to be revisited by forward-thinking members of Congress,” James J. Leonard Jr. said.
His next legal option is to petition to the full Third Circuit Court and he has 45 days to do so,” according to a source. “His final legal option if that is denied is to petition the Supreme Court. It is not yet determined if he will take the next steps to further appeal, but it’s being discussed.”
The source continues, “When they had turned down the chance to hear oral arguments, that is typically not a good sign, and it turns out it wasn’t. However, his team did garner some optimism when the case sat since November without any decision from the Third Circuit, but unfortunately it didn’t turn out to be an indication that there would be a favorable decision.”
The presiding judge ruled that he did indeed commit an aggravated felony, defined in court documents as “an offense that involves fraud or deceit in which the loss to the victim or victims exceeds $10,000”), which provides grounds for deportation. However, Joe argued “that because his loans were later forgiven, there was no loss,” but the court was “not persuaded.”
Joe, 47, was also denied his appeal on two technicality arguments.
Joe is currently living in Sala Consilina, Italy, while his estranged wife Teresa, 47, is living in New Jersey with their four daughters, Gia, 19, Gabriella, 15, Milania, 14, and Audriana, 10.
Joe tells The Hollywood Gossip, “As I proceeded with caution, hoping to win the judge’s sympathy. I was hoping to come home to my girls, Today, According to U.S immigration I was told I will never step foot in America again. That is a horror that most of us cannot even imagine. My appeal was denied. The dreadful words no one wants to hear, especially now. I always feel I belong in the United States with my family, not in Italy,” Joe correctly affirms to us. My heart is aching. My limbs feel weak. I won’t see my girls glowing smile that I loved waking up with every morning now, That makes me scared it means that my kids world will be without me.”
